Additional Terms & Conditions

These Additional Terms and Conditions (the “Additional Terms”) supplement and are

incorporated by reference into your Agreement. These Additional Terms may be amended from

time to time at the sole discretion of the Company and shall be binding notwithstanding. By

signing your Agreement, you (the “Customer”) acknowledge and agree to these Additional

Terms.

1. PAYMENT FOR SERVICES. payment for all Services hereunder shall be due upon the

commencement of such Services, unless otherwise indicated herein in writing. Unpaid

invoices shall be subject to monthly interest in the amount of 1.5% of the total amount

due in addition to any reasonable attorney’s fees incurred for the collection thereof.

Drywall repairs and permit fees are the sole responsibility of the Customer. Deposits and

permit fees are nonrefundable. Customer acknowledges that all parts and supplies have

been inspected by Customer and are in good working order. Services rendered shall be

done in accordance with (NEC) National Electric Code.

2. ADDITIONAL PAYMENT TERMS. Fifty percent (50%) of fees for Services are due and

payable upon execution of the Agreement; twenty-five (25%) due and payable at rough;

and the remainder for fees shall be. due and payable at final. Final payments are due

upon completion of Services. All applicable permit fees are due upon passing of

applicable inspection.

3. TERMINATION. Simon Electric, LLC reserves the right in its sole discretion to terminate

this Agreement, stop work, or terminate any obligation hereunder for failure of

Customer to submit the required deposit, and where a rough draw and/or change order

draw has not been timely made; or for any material breach of this Agreement.

4. GOVERNING LAW. The Agreement and these Additional Terms shall be governed by the

laws of Florida, USA with venue for any disputes or claims in Broward County Florida,

USA

5. Disclaimer & Limitation of Liability. UNLESS REQUIRED BY LAW OR AGREED TO IN

WRITING, ALL EXPRESS OR IMPLIED CONDITIONS, REPRESENTATIONS AND WARRANTIES

INCLUDING ANY IMPLIED WARRANTY OR MERCHANTABILITY, FITNESS FOR A

PARTICULAR PURPOSE OR NON-INFRINGEMENT ARE DISCLAIMED. THE TOTAL AMOUNT

OF DAMAGES RECOVERABLE BY CUSTOMER UNDER THIS AGREEMENT IN ANY LEGAL

MATTER SHALL NOT EXCEED, IN AGGREGATE, THE TOTAL AMOUNT PAID BY CUSTOMER

FOR THE SERVICES WHICH GIVE RISE TO THE CLAIM. IN NO EVENT SHALL SIMON

ELECTRIC BE LIABLE FOR ANY PUNITIVE, INCIDENTAL, SPECIAL OR CONSEQUENTIAL

DAMAGES IN ANY ACTION ARISING FROM OR RELATED TO THIS AGREEMENT OR THE

SERVICES AND GOODS PROVIDED. 

 Posting false, misleading, or malicious reviews about our services on social media is strictly prohibited. We will take legal action against individuals who post false reviews, including defamation lawsuits. Users are responsible for ensuring the accuracy of their reviews before posting. We reserve the right to request removal of false reviews and may pursue further legal action if necessary.
